HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.34215 OF 2018 ORDER:

This writ petition came to be filed seeking to declare the action of the respondents 2 and 3 in not conducting survey and fixing the boundaries in respect of lands admeasuring Ac.0.41 cents, situated at Sy.No.63 of Vijalapuram Village, Ramakuppam Mandal, Chittoor District as illegal and arbitrary.

When the matter is taken up for hearing, learned Government Pleader for Revenue, would submit that earlier a notice was issued to the petitioner asking him to be present at the subject property for conducting the survey, but the petitioner was not present and as such the survey could not be conducted. However, learned Government submits that the petitioner may be directed to submit a fresh application seeking to conduct the survey of the subject land and in which event, the respondent-authority, may be directed to consider it in accordance with law.

Having regard to the facts and circumstances of the case, the writ petition is disposed of directing the petitioner to make a fresh application to the respondents 2 and 3, seeking to conduct the survey of the subject land, in which event, the respondents 2 and 3, shall deal with the same and pass appropriate orders, in accordance with law, as early as possible, preferably within a period of three to four weeks from the date of submission of the application by the petitioner, after giving reasonable opportunity of hearing to the petitioner and all concerned. With the above direction, the writ petition is disposed of. No order as to costs. As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand closed.
