ORDER
This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioners, who are arrayed as accused Nos.2 to 5 in Crime No.101 of 2025 before the
Narva Police Station, Narayanpet, registered for the offences punishable under Sections 85 and 108 read with 3(5) of BNS. 2.
The brief facts of the case are that the defacto complainant lodged a complaint before the Police stating that his sister Sandhya, who had been married to Ramu for about eight years and had three children, was subjected to continuous harassment by her husband, parents-in-law, and brothers-in-law for additional dowry and transfer of land. Despite several panchayats and counselling by the police, the harassment allegedly continued.
On 03.10.2025 the complainant reported that Sandhya was found dead in her matrimonial home under suspicious circumstances and that a stab injury was noticed on her neck, suspecting that she was killed due to the alleged harassment. Basing on the said complaint, the Police registered the case for the above said offences.

Heard Sri M. Achutha Reddy, learned counsel appearing on behalf of the petitioners as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioners submitted that the allegations were false and the petitioners had no role in the death of the deceased and that the deceased and her husband had been living separately for years due to frequent marital disputes unconnected with the petitioners, and that no complaint had ever been made against them during her lifetime. He further submitted that after the deceased's death, her husband was assaulted by the complainant's relatives, due to which he later committed suicide, leaving their three children orphaned and presently in the care of the petitioners. He contended that the allegations were vague, did not attract the ingredients of Section 108 BNS. Therefore, he prayed the Court to grant pre-arrest bail to the petitioners by allowing this Criminal Petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners stating that the allegations leveled against the petitioners are serious in nature. Further, the investigation was not yet completed. At this stage, granting of pre-arrest bail to the petitioners does not arise. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon a perusal of the material available on record, it appears that petitioner Nos.1 and 2 are the parents of accused No.1 and petitioner Nos.3 and 4 are the brothers of accused No.1. The allegations against the petitioners are that they had harassed the deceased in the name of additional dowry; however, the material placed before this Court indicates that accused No.1, the husband of the deceased, has already committed suicide and that the petitioners are presently taking care of the three minor children of the deceased. Considering the facts and circumstances of the case, this Court deems it appropriate to grant pre-arrest bail to the petitioners, subject to the following conditions:
i.
The petitioners shall surrender before the Station House Officer, Narva Police Station, Narayanpet District, within two weeks from today, and on such surrender, the said Station House Officer shall release them on bail on executing a personal bond for Rs.25,000/-, each, with two sureties, for the like sum each.
ii.
The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioners shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required 7.
Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
