THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.34356 of 2018 ORDER:
When the matter is taken up, written instructions dated 27.09.2018 furnished by the Sub Inspector of Police & SHO, Pedacherlopalle PS, Prakasam District are placed on record by the learned Government Pleader for Home.
To the extent of their relevance to the present writ petition, the said instructions read as under:
"It is submitted that one Davalam Laxmamma & 3 others, belonging to Sc-Mala have approached 3rd respondent herein on 19.06.2018 and lodged a written complaint stating that they are the beneficiaries under the 'Land Purchase Scheme' of SC Corporation and the extents of lan in Sy.Nos. in Sy.Nos.845 & 855 were distributed to them by the SC Corporation in the year 1990-91, wherein certain other persons belonging to SC-Madiga, have been interfering with the same and requested the police to do needful in the matter. It is submitted that on receipt of the above complaint, the same was entered in the General Diary of the police station on 19.06.2018, the same was examined, wherein it is found that the issue relates to purely 'Civil in Nature'. Therefore, the complainant was advised to approach the competent civil court in respect of their grievance.
It is submitted that the allegations of the 3rd respondent for the last one week summoning the petitioners to the police station and insisting them to vacate the said property and hand over the same to others and threatening to vacate them by using force and provoking the villagers to enter into land, are all false and baseless. The further allegation of the petitioner that the 3rd respondent has been interfering in the civil disputes of the petitioners at the instance of the local ruling party leaders, is factually incorrect. In fact, the 3rd respondent has never interfered in the civil disputes of the petitioners in respect of the land in question at any point of time.
It is bumitted that the petitioners have filed this writ petition with all false and baseless allegations against the 3rd respondent under apprehension that the police may take action against them basing on the complaint dt.19.06.2018 of one Davalam Laxmammam & 3 others, which is totally unfounded. As stated supra, the said complaint was closed on 19.06.2018 as 'Civil in Nature', on 19.0.2018 itself. Therefore, all the allegations of the petitioners against the 3rd respondent are concocted only for the sake of filing this writ petition. It is reiterated that the 3rd respondent herein has never interfered in the civil disputes of the petitioners at any point of time. All the allegations of the petitioners in this regard against the respondent police authorities are incorrect, untenable and hereby specifically denied."
Having regard to the written instructions and taking into consideration the submissions of the learned counsel for the petitioner and the learned Government Pleader for Home, this Court deems it appropriate to dispose of the writ petition by placing on record the above said instructions. Accordingly, the writ petition is disposed of by placing on record the written instructions dated 27.09.2018 furnished by the Sub Inspector of Police & SHO, Pedacherlopalle PS, Prakasam District. There shall be no order as to costs. Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
