THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN Contempt Case No.2299 of 2013 ORDER:

The order, violation of which is alleged in this Contempt Case, is the order passed in W.P.M.P.No.39064 of 2013 in W.P.No.31444 of 2013 dated 12.11.2013 whereby respondents 1 to 3 were directed not to proceed with construction of the building, except after obtaining permission from the concerned Gram Panchayat. A counter affidavit is filed, on behalf of the respondents, by the District Project Officer, Rajiv Vidya Mission, stating that the Special Officer, Peddacheppali Gram Panchayat, Kamalapuram Mandal, YSR District, vide proceedings dated 24.03.2013, had permitted the Convener, School Management Committee to construct the sanctioned rooms in the site of the Zilla Parishad High School, Peddacheppali of Kamalapuram Mandal.

As the construction, being made by the respondents, is pursuant to the grant of permission for construction, by the Special Officer dated 24.03.2013, the order of this Court cannot be said to have been violated, much less willfully and deliberately. I see no reason, therefore, to proceed against the respondents under the Contempt of Courts Act.

The Contempt Case is, accordingly, closed. The Contempt Applications, pending, if any, shall also stand closed. There shall be no order as to costs.
