HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.4207 of 2015 ORDER :

This Criminal Petition is filed by the Petitioners/Accused Nos.1 to 3 under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.38 of 2015 of Rangampeta Police Station, East Godavari District registered for the offences punishable under Sections 448, 326 read with 34 I.P.C and Section 3(1)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

2) Heard the learned counsel for the petitioners as well as the 1st respondent represented by the Public Prosecutor before admission and before ordering notice to the 2nd respondent-defacto-complainant and perused the material on record.

3) As the material falls short for admission of the petition under Section 482 Cr.P.C, the application is disposed of giving liberty to the petitioners to surrender before the learned Special Judge and file regular bail application with notice to the Special Public Prosecutor concerned and in such an event, the learned Special Judge shall grant bail disposing of the same with necessary conditions preferably on the same day.

4) As a sequel, miscellaneous petitions pending, if any, in this criminal petition shall stand closed.
