THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9038 of 2015 ORDER:

This criminal petition, under sections 437 & 439 of the Code of Criminal Procedure, is filed by the petitioners-Accused Nos.1 and 2 seeking to grant bail in connection with crime No.191 of 2015 on the file of Prohibition & Excise Station, Prathipadu, East Godavari District, registered for the offence punishable under Section 8(c) read with 20(b) of the Narcotic Drugs and Psychotropic Substances Act. The case of the prosecution is that on reliable information of transportation of ganja, on 21.06.2015 the Prohibition & Excise Police, Prathipadu found the petitioners in possession of 220 kgs., of dry ganja while they were transporting the same in a car bearing No.TN 57 D 1452.

Heard and perused the material available on record. A perusal of the record discloses that the seized ganja is about 220 kgs., which is more than the commercial quantity. Hence, this Court is not inclined to grant bail to the petitioners at this stage. Accordingly, the Criminal Petition is dismissed. ______________ RAJA ELANGO, J September 10, 2015 KTL
