THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.2280 of 2016 ORDER:

The petitioner, who is JCL in Crime No.65 of 2016 of Karimnagar I Town Police Station, filed the present application under Sections 437 and 439 Cr.P.C. seeking enlargement on bail in the above Crime, registered for an offence punishable under Section 379 IPC.

A perusal of the material on record would disclose that the petitioner preferred an application under Section 12 (2) of the Juvenile Justice Act, 2000, before the Juvenile Justice Board, Karimnagar, which was dismissed on 12.02.2016. Aggrieved by the same, the present Criminal Petition is filed.

Referring to Page No.2 of the order, learned counsel for the petitioner submits that there is enough material to show that one Laxmi is the mother of the Juvenile, but the said material was not placed before the Board while the application made under Section 12 (2) of the Juvenile Justice Act, 2000 came up for consideration. Hence he seeks permission to withdraw the Criminal Petition with a liberty to move the Board again by filing necessary documents.

Permission as sought for is accorded.
