It is stated by the learned counsel for the petitioner that the order impugned in this Revision Petition has to be considered as an order under Order 21 Rule 92 CPC which is appealable under Order 43 Rule 1 (j) CPC in the District Court.

In this view of the matter, the learned counsel for the petitioner seeks to withdraw this Revision Petition with liberty to avail the remedy of appeal before the District Court under the above provision of law. 3.

Granting liberty as sought, this Civil Revision Petition is dismissed as withdrawn. No costs. 4.

As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
