The writ petition has been filed by the petitioner seeking Mandamus declaring the action of the 2nd Respondent in issuing the Proceedings No.C3/14131994-2017 dated 11.09.2017 transferring him from Jawaharlal Nehru Technological University, Hyderabad, College of Engineering, Sultanpur Village, Pulkal Mandal, Sangareddy District to Jawaharlal Nehru Technological University, Hyderabad, College of Engineering, Manthani, Peddapalli District herein as illegal and arbitrary.

Heard learned counsel for the Petitioner and the learned Standing Counsel appearing for the respondents.

The learned counsel for the petitioner submits that the petitioner has been working as Dy.Executive Engineer, in the respondents' University entrusted to supervise the construction of Engineering Colleges at Kondagattu and attacked with Cardivascular in April, 2017 due to which he was affected with paralytic stroke and that on the advise of the doctors to take rest, he applied medical leave for 45 days from April, 2017 to 31.5.2017 and that similarly situated persons are continuing in the Headquarters at Hyderabad whereas, the petitioner who worked for more than 10 years outside the headquarters and hence, the impugned proceedings issued by the 3rd Respondent without considering the representation of the petitioner dated 14.09.2017 submitted by the petitioner. 4.

The learned Standing Counsel appearing for the respondents admits that the representation dated 14.09.2017 submitted by the petitioner is pending before the competent authority of the Respondents' University.

In view of the above submissions and since the representation of the petitioner is pending before the respondents, without expressing any opinion on merits, the 2nd Respondent is directed to dispose of the representation dated 14.09.2017 submitted by the Petitioner within four (4) weeks from the date of receipt of the Order, without implementing the impugned Order. Till then, the Respondents are directed to continue the Petitioner in the same place where presently, he has been working.
