This criminal petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, by the petitioners/A.1 to A.3 seeking anticipatory bail in connection with Crime No.2181 of 2025 of Narsingi Police Station,
- 2 - Cyberabad District. The offences alleged against the petitioner are under Sections 308(5) r/w.3(5) of Bharatiya Nyaya Sanhita, 2023 (for short 'BNS').

The facts of the case are that the defacto complainant lodged a report before police on 13.11.2025 stating that A.1 along with A.2 and A.3 entered into her house and taken away gold worth of Rs.80 lakhs and also some bond papers, that the complainant is staying in the house basing on the bond paper given by the petitioner No.1. Earlier also the petitioners trespassed into the house of complainant and also committed theft of gold and other papers. Hence, requested the police to take necessary action against the accused. Basing on the said complaint police registered the case against the accused for the said offences.

Heard Sri Mettu Shankar, learned counsel for the petitioners and Sri D.Arun Kumar, learned Additional Public Prosecutor appearing for respondent-State.

The contention of learned counsel for the petitioners is that petitioners are innocent of the said allegations. In fact the 1st petitioner lodged a report before police on 11.11.2025 whereas police registered the same on 13.11.2025 vide FIR
- 3 - No.2186 of 2025 for the offences under Sections 329 (4), 352 r/w.3(5) of BNS. The present crime is a counter blast to the complaint filed by the 1st petitioner. In fact 1st petitioner is the owner of the said villa purchased from the RBL Bank on 10.07.2021 and the complainant is residing in the said village illegally. As such, no offence is committed by the petitioners and that the petitioners are ready to cooperate with the investigation and prayed to grant bail to the petitioners. 5.
On the other hand, learned Additional Public Prosecutor opposed bail stating that the allegations against the petitioners are serious in nature. As such, petitioners are not entitled for bail and prayed to dismiss this petition.

Having regard to the submissions made and the material placed on record admittedly, there is a civil dispute pending between the parties. The averments show that the 1st petitioner herein gave a bond paper to the complainant to reside in the subject house and that the contention of petitioners herein is that the 1st petitioner is the owner of the said house and the complainant is illegally residing in the same. Considering these facts, the custodial interrogation of the petitioners is not
- 4 - necessary. Hence, this Court deems it fit to grant anticipatory bail to the petitioners subject to the following conditions : i.
The petitioners/A.1 to A.3 shall surrender before the Station House Officer, Narsingi Police Station, Cyberabad within two weeks from today, and on such surrender, the said Station House Officer shall release the petitioners/A.1 to A.3 on bail on their executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties, for the like sum each.
ii.
The petitioners/A.1 to A.3 shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight
(8) weeks, for the purpose of investigation and thereafter, as and when required.
iii.
The petitioners/A.1 to A.3 shall abide by the other conditions stipulated in Section 482(2) of BNSS and co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed.
