ORDER
This Criminal Petition is filed seeking the Court to enlarge the petitioner on bail who is arrayed as accused in Crime No.779 of of Panjagutta Police Station,
Hyderabad, registered for the offences punishable under Sections 121(2), 351(2), 352 and 281 of BNS.

The brief facts of the case are that on 06.11.2025, a complaint was lodged by the Addl. Inspector of Police, Panjagutta Traffic PS, alleging that the petitioner, while driving a four-wheeler, had jumped the signal at Panjagutta junction, abused and obstructed the traffic staff, tore a Home Guard's uniform, pushed police personnel, and fled towards NFCL Junction. He was later stopped with public assistance but again drove rashly and threatened the police before being apprehended. Based on this, he was arrested on the same day, and the sections were later altered to 121(2), 351(2), and 281 BNS before he was remanded to judicial custody on 07.11.2025.

Heard Sri B. Vamshidhar Reddy, learned counsel appearing on behalf of the petitioner as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the allegations were false and fabricated, and that the police created a concocted version to harass the petitioner, and he was suffering from ill health. He further submitted that the alleged victim was only a Home Guard and not a public servant and therefore Section 121(2) was not attracted. He further submitted that the petitioner himself sustained injuries during police assault, the investigation was already completed, the petitioner had no criminal history. Therefore, he prayed the Court to grant bail to the petitioner by allowing this Criminal Petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the there are serious allegations against the petitioner. Further, the investigation was not yet completed. At this stage, granting of bail to the petitioner does not arise. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by the learned counsel on both sides, and upon a perusal of the material
available on record, it appears that the petitioner has been in judicial custody since 07.11.2025. The record further discloses that the material part of the investigation has been completed and that L.Ws.1 to 13 have already been examined. It is also brought to the notice of this Court that the petitioner has recently met with a serious accident and is presently suffering from health complications requiring proper medical care. Considering the facts and circumstances of the case, the stage of investigation and considering the health condition of the petitioner, this Court is of the opinion that the petitioner is entitled to be enlarged on bail subject to the following conditions:
i.
The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned XIV Additional Chief Judicial Magistrate, Nampally, Hyderabad.
ii.
The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of
investigation, and thereafter, as and when required.
iii.
The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
