THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY CONTEMPT CASE NO.2146 OF 2015 IN W.P.M.P.NO.18633 OF 2015 IN W.P.NO.14225 OF 2015 O R D E R:

This contempt case is filed by petitioner seeking to summon the first respondent/writ petitioner and punish him for willful disobedience of the orders passed by this Court, dt.04.05.2015 in W.P.M.P.No.18633 of 2015 wherein it was directed to maintain status quo obtaining as on that day till 10.06.2015 and thereafter extended the said order till order, dt.23.06.2015.

The learned counsel for the petitioner contends that in spite of granting status quo by this court, the respondent is proceeding with the further construction.

The respondent filed counter affidavit by stating that after passing of interim order of status quo, he has not constructed any thing and the petitioner has not disclosed anything about the construction work made by him after passing of the said order by this court and sought for dismissal of the contempt case.

No reply affidavit is filed by the petitioner. Since it is stated in the counter affidavit that no construction has been made by the respondent in violation of the interim order of status quo passed by this court, the contempt case is liable to be dismissed.

The contempt case is, therefore, dismissed. No order as to costs.
