THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.34239 of 2018 ORDER:
When the matter is taken up, written instructions dated 24.09.2018 furnished by the Sub Inspector of Police, Jadcherla Police Station, Mahabubnagar District are placed on record by the learned Government Pleader for Home.
To the extent of their relevance to the present writ petition, the said instructions read as under:
"The petitioner herein has approached the police of Jadcherla Police Station and lodged a complaint on 29.08.2018 at 17.30 hrs stating that to prevent Mr.R.Karunakar Naik SGT and his mother Smt.Pentamma from frequently coming to his house and harassing him and that on 29.8.2018 they came to his house bearing No.5237/A, Prashantnagar colony of Jadcherla village and Mandal and harassing him and hence requested to take necessary action as per law.
Upon receipt of said complaint, an entry was made into the Station General Diary, after enquiry action will be taken. Since the contents of the complaint appeared to be noncognizable in nature attracting the provisions of Section 504, 506 r/w 34 IPC and hence, a requisition was filed before the Hon'ble Court of Judl.Magistrate of First Class at Jadcherla on complaint. The same is pending consideration. A copy of the requisition filed before the concerned Hon'ble Court to the written instructions for the kind perusal of the Hon'ble Court.
As soon as permission is accorded, this respondent will take further course of action on the non-cognizable complaint dt.29.8.2018 of the petitioner herein and the ame will be communicated to the petitioner herein.
It is humbly submitted that the allegation of the petitioner that this respondent calling the petitioner to the police station from morning to evening and make him to sit in the police station from morning to evening and threatening
and pressurizing him to withdraw the complaint given by him on 29.8.2018 is absolutely false and hence denied. As soon as the permission is obtained from the Hon'ble Court, appropriate action will be taken on the non-cognizable complaint of the petitioner herein.
It is submitted that the allegation of the petitioner that this respondent called him on 30.8.2018 and making him to sit in the police station from morning to evening and threatening him to withdraw the complaint against the 5th respondent who is none other than his son and warned him that his respondent given 3 days time to withdraw cases otherwise this respondent police will deal him in their own police methods is utterly false and hence denied. It is humbly submitted that no case whatsoever was registered against the petitioner herein. The petitioner herein is not at all required in any case registered on the file of Jadcherla Police station. I humbly submit that at any point of time, this respondent never summoned the petitioner no made him to sit in the police station nor ask him to withdraw the complaint dt.29.8.2018 given against his son." On noticing the above instructions, a request is made by the learned counsel for the petitioner to place the said instructions on record and dispose of the writ petition.
Accordingly, the writ petition is disposed of by placing on record the written instructions dated 24.09.2018 furnished by the Sub Inspector of Police, Jadcherla Police Station, Mahabubnagar District. There shall be no order as to costs. Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
