Heard Ms. K. Anuradha for petitioner and the learned Assistant government Pleader for respondents.
2. The petitioner complains against the alleged oral demand of 3rd respondent in calling upon the petitioner to handover an extent of Ac.1.00 cents out of Ac.2.00 cents in Sy.No.123/ 2 of Pandillapalli Village, Vetapalem Mandal of Prakasam District, without recourse to law, as illegal and unconstitutional.
3. At request of respondents, the writ petition is directed to be heard for admission today. The Assistant Government Pleader places on record the instructions of even date and the operative portion of the instructions read thus:
" It is utterly false to state that the 3rd respondent is pressurizing him to hand over Ac.1.00 out of the land of Ac.2.00 in S.No.123/ 2 of Pandillapalli village, which was assigned to him. Any action to resume the land in favour of Government will be taken according to rules and after following due process of law only."
4. The statement of 3rd respondent is placed on record and accepted. The writ petition is disposed of accordingly. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
