CVNR, J & MSKJ, J WP.Nos.7829 & 7832 of 2017 Dated:11.9.2017 COMMON ORDER: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) Feeling aggrieved by common order, dated 06.02.2017, of the Andhra Pradesh Administrative Tribunal at Hyderabad (for short 'the Tribunal) in Original Application Nos.270 and 271 of 2017, the applicants therein filed these Writ Petitions respectively.

In the said O.As., the petitioners have assailed the validity of G.O.Ms.No.1, Home (Legal.II) Department, dated 07.01.2016. The Tribunal declined to entertain the said O.As on the ground of availability of alternative remedy of appeal to the petitioners under Rule-26 (a) of the Andhra Pradesh State and Subordinate Service Rules, 1996. Certain other persons have also filed O.As before the Tribunal assailing the afore-mentioned G.O., wherein a similar order was passed by the Tribunal. Assailing the said order, some of the applicants therein filed appeals before respondent No.2 besides approaching this Court by filing Writ Petitions, one of which is Writ Petition No.13085 of 2017. By a separate order passed by us today, we have disposed of the said Writ Petition with a direction to respondent No.2 to dispose of the appeals stated to have been filed by the petitioners therein. Mr. N.Ramesh, learned counsel for the petitioners, submitted that his clients are also prepared to avail the remedy of filing appeal before respondent No.2.

CVNR, J & MSKJ, J WP.Nos.7829 & 7832 of 2017 Dated:11.9.2017 In the light of the above facts and the submission made by the learned counsel, as noted hereinbefore, the Writ Petitions are disposed of, without adjudicating the same on merits, with liberty to the petitioners to file appeals before respondent No.2. Respondent No.2 shall dispose of such appeals by passing speaking orders, after giving an opportunity of personal hearing to the petitioners. Till the above exercise is completed, the seniority proposed to be revised shall not be given effect to. As a sequel, interim orders, dated 28.3.2017, are vacated and WPMP.Nos.9657 and 9661 of 2017 are disposed of as infructuous.
