Heard counsel for the petitioner, the Government Pleader for Energy appearing for 1st respondent and Sri N.Siva Reddy, Standing Counsel appearing for respondents 2 to 4.

Petitioner has assailed in this Writ Petition proceedings dt.02.08.2018 of the 4th respondent provisionally assessing liability of the petitioner as Rs.21,16,862/- after an inspection done on 01.08.2018, wherein it is alleged that pilferage of energy was detected, and the impugned order directs the petitioner to pay the entire assessed amount for getting reconnection.

However, it is stated across the bar that petitioner had paid 50% of the provisionally assessed amount and the electricity supply has been restored to the petitioner's unit. 4.

Therefore, the Writ Petition is disposed of directing the respondents to refer the matter to the Special Court constituted under Section 154(5) of the Electricity Act, 2003 for determination of civil liability of the petitioner and pending such determination, the power supply to the petitioner's unit shall not be disconnected by the respondents. No order as to costs.

Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
