THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.40 OF 2017 ORDER :

Heard. With the consent of both the parties, the Writ Petition is disposed of at the admission stage.

Alleging that the respondent-Municipal Corporation is threatening to dispossess the petitioner and remove the shop from the existing location, this writ petition is filed. 3.

According to learned counsel for the petitioner, Petitioner has been running Tea and Pan shop for the last 25 years in the name and style of Prasannanjaneya Tea and Pan shop at Indira Gandhi Nagar, Visakhapatnam.

When the matter is taken up, learned Standing counsel, submits that complaints were received against continuation of the shop at the present location. However, he would submit that due process would be followed before seeking to vacate the petitioner and remove the shop from the present location. 5.

Having regard to the said submission, the Writ Petition is disposed of, directing the respondent-Corporation to follow due process, if they intend to dispossess the petitioner and remove the shop from the present location. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
