HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.6081 of 2015 ORDER :

This criminal petition is filed by the petitioners/A.2 to A.6 under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.74 of 2015 of Amangal Police Station, Mahaboobnagar District, registered for the offences punishable under Sections 420 and 120-B IPC.

2. Heard the learned counsel for the petitioners as well as the 1st respondent-State represented by the Public Prosecutor before admission and before ordering any notice to the 2nd respondent and perused the material on record.

3. The material falls short for this Court to admit the application under Section 482 Cr.P.C. to quash the F.I.R., but for the factual matrix otherwise entitled to the concession of bail by the petitioners/A.2 to A.5, of whom A.2 is the wife of A.1, who is said to be earlier agreement holder to the complainant and that the subsequent socalled agreement is executed by A.1 and A.2 in turn and in saying A.2 in turn sold the property to A.3, attested by A.4 to A.6.

4. Accordingly, the criminal petition is disposed of giving liberty to the petitioners to surrender before the learned Magistrate concerned and move for regular bail and after notice to APP concerned, the learned Magistrate

shall grant bail preferably on the same day with necessary conditions. Needless to say, the learned Magistrate shall dispense with the personal appearance of the petitioners at the post bail stage and pending investigation. Any further remedy in the event of police filing final report and any cognizance taken by the Court is left open to the petitioners.

5. Accordingly, the criminal petition is disposed of.
