HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 45836 of 2016 ORDER:

1) Heard learned counsel for the petitioner and Government Pleader for Revenue. With the consent of both the parties, the main writ petition is being taken up for disposal at the admission stage itself.

2) The present writ petition came to be filed with the following prayer:

" issue a writ of mandamus declaring the inclusion of the petitioner's land admeasuring Ac.3.88 cents in Sy.No.685 of Peddapodilla Village, Peapully Mandal, Kurnool District, in the prohibitory list of properties furnished by the third respondent, whereunder the registration of the aforesaid property is prohibited, as illegal and arbitrary and contrary to statutory provisions of Sections 22-A (1) (b) (e) 2 of the Registration Act, 1908; and consequently direct the fourth respondent to receive and entertain any sale deed being presented by the petitioner for registration in respect of the said land."

3) Though various grounds are raised in the writ petition, learned counsel for the petitioner submits that the petitioner may be permitted to file an application before the Committee constituted pursuant to the Full Bench Judgment of this Court in Vinj amuri Raj agopala Chary v. St at e of A.P., and ot hers1, for 1 2016 (2) ALD 236 (FB)

deletion of the property from the prohibitory list, in which event, the same may be considered.

4) Learned Government Pleader would submit that he has no objection for the same.

5) Having regard to the above, the writ petition is disposed of directing the petitioner to make an application before the Committee constituted pursuant to the above referred Full Bench Judgment of this Court, within a period of two (02) weeks, in which event the same shall be dealt with in accordance with law, within a period of four to six weeks thereafter, after hearing the petitioner and the aggrieved persons, if any. 6) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs.
