Sri Nageshwara Rao Pappu, learned counsel for the petitioner, states that aggrieved by the order dated 09.06.2010 passed by the Commissioner of Police, Hyderabad City, cancelling the petitioner's Arms Licence, he preferred an appeal to the wrong appellate authority going by the misprint in a text book. A copy of the said text book was also placed before this Court. Learned counsel now states that as the appeal was not in accordance with the rules, liberty may be given to the petitioner to approach the appropriate authority as described in Rule 5 of the Arms Rules, 1962 assailing the order dated 09.06.2010 passed by the primary authority. Reserving liberty to the petitioner to do so, the writ petition is closed. Needless to state, the appellate authority shall duly take into consideration the fact that the petitioner prosecuted his first appeal before the wrong authority and
thereafter filed this writ petition, while reckoning the period of limitation. Pending Miscellaneous Petitions, if any, shall also stand closed. No order as to costs.
