THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.34243 of 2018 ORDER:

When the matter is taken up, written instructions dated 26.09.2018 furnished by the Station House Officer, Chandanagar PS, Cyberabad are placed on record by the learned Government Pleader for Home.

To the extent of their relevance to the present writ petition, the said instructions read as under:

"On reference from the Hon'ble Court vide Dis.No.1137/2018, dated 10.07.2018 Chandanagar Police, Cyberabad registered FIR No.453/2018, u/s 406, 420, 478, 379, 302, 120b IPC, 156 (3) Cr.P.C. dated 20.07.2018 and took up for investigation.

It is submitted that during the course of investigation, Section 91(a)/160 Cr.P.C notice dated 23.07.2018 was issued to the petitioner to produce relevant evidence pertaining to the case and also to produce any witnesses in support of his version. As there was no response to the said notice, reminder notices were issued to him on 30.7.2018 and 10.8.2018. The petitioner promised to submit the documents within a week, as he was busy in his business. On 26.08.2018 the petitioner produced some documents. His statement was also recorded. It is pertinent to submit here that, regarding the death of 4th respondent's father, a case in Crime No.333/2018 u/s 306 IPC, dated 23.5.2018 was registered based on the complaint given by the auto driver i.e., 6th respondent herein, wherein the petitioner herein was Accused No.1 and his friend Alluri Bhanu Prakash Varma is Accused No.2 and both A1 and A2 filed Crl.P.No.6284/2018 before the Hon'ble Court and the Hon'ble High Court by orders dated 10.8.2018 quashed the said FIR No.333/2018.

It is submitted that, the investigation in the case is completed and appropriate report will be filed before the concerned Court within a short period."

On noticing the above instructions, a request is made by the learned counsel for the petitioner to place the said instructions on record and dispose of the writ petition.

Accordingly, the writ petition is disposed of by placing on record the written instructions dated 26.09.2018 furnished by the Station House Officer, Chandanagar PS, Cyberabad. There shall be no order as to costs.

Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
