THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.34325 of 2018 ORDER:

When the matter is taken up, written instructions dated 24.09.2018 furnished by the Inspector of Police, Langer House Police Station are placed on record by the learned Government Pleader for Home.

To the extent of their relevance to the present writ petition, the said instructions read as under:

"It is humbly submitted that to know the veracity in the contents of the petition of the complainant/7th respondent herein, this respondent tried to contact the petitioner over phone, he did not turned up to the police station nor informed anything about the contents of the complaint but he filed the present writ petition as a precautionary measure with false and frivolous allegations.

It is humbly submitted that the dispute of the complainant/7th respondent herein and as well as the petitioner herein is purely civil in nature relating to money transaction, immediately, this respondent advised the 7th respondent/complainant to seek his redressal in a competent court of law. As of now, no case whatsoever was registered against the petitioner herein on the said complaint of the 7th respondent herein on the file of the Langer House Police Station, Hyderabad.

It is pertinent to submit that no case whatsoever was registered against the petitioner and he is not at all required in any case and this respondent never interfered with the personal life and liberty of the petitioner herein as alleged. It is submitted that the allegation of the petitioner that this respondent came to the Police of Asif Nagar Police Station/3rd respondent and took him to this respondent police station of Langer House and beaten him black and blue and at last in the night at about 09.30 hrs he and his friend left from their custody is absolutely false, baseless and hence denied.

It is submitted that this respondent abused official position and harassing him without showing any reason is utterly false and hence denied.

It is submitted that the allegation of the petitioner that the 7th respondent herein is highly influential, for which, he has facing all the harassment in the hands of this respondent is false and hence denied.

It is submitted that the allegation of the petitioner even though there are no cases pending against him in both the police stations ie., 3rd and 4th respondent but they have beat him black and blue for no reason and hence he made them parties in person for abusing their colour of authority and in both the police stations, some of the constables beat him and the constables have no name tags on their shirts and hence he is not able to reveal their names but can identify them in person and this respondent warned him to give a cheque worth Rs.3,00,000/- to the 7th respondent on the very next day is absolutely false, baseless, concocted, exaggerated and invented for the purpose of filing the present writ petition and hence the same is totally denied.

It is submitted that the allegation of the petitioner that he is not able to understand the personal interest of the police authorities in a matter of money recovery and obtaining signatures on blank promotes and papers and that this respondent is repeatedly calling him to settle the matter with the 7th respondent and is interfering with his life and liberty is also utterly false and hence denied.

It is pertinent to submit that on receipt of complaint from the 7th respondent herein, this respondent to know the veracity in the contents of the same, tried to contact the petitioner over phone regarding facts in the complaint. He did not turned up nor submit any proper information but he filed the present writ petition with exaggerated allegations. I humbly submit that this respondent never summoned the petitioner, nor ask him to sit in the police station nor obtain any signatures on blank papers or promissory notes as alleged.

I humbly submit that this respondent never interfered with the civil disputes muchless the dispute of the petitioner herein.

It is pertinent to submit that on coming to know the lodging of the complaint by the 7th respondent herein with this respondent police station, to prevent the police from taking any action in the event of registration of any crime against him, the petitioner filed the present writ petition with false, concocted and baseless allegations.

All the allegations made by the petitioner in the affidavit are false, frivolous and mainly exaggerated and hence they are totally denied."

Having regard to the written instructions and taking into consideration the submissions of the learned counsel for the petitioner and the learned Government Pleader for Home, this Court deems it appropriate to dispose of the writ petition by placing on record the above said instructions. Accordingly, the writ petition is disposed of by placing on record the written instructions dated 24.09.2018 furnished by the Inspector of Police, Langer House Police Station. There shall be no order as to costs.

Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
