HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.35241 of 2016 ORDER:

Petitioner prays for the following relief:

.....Writ of mandamus declaring the action of the respondents in issuing a notice of demand vide dated 04.08.2016 in Lr.No.ADE/OP/HYNG/D.No.1267/16-17 to the petitioner service connection vide S.No.5626 02307 with USC 109373787 without following the prescribed procedure under clause 10 of General Terms and Conditions of Supply is arbitrary, illegal and against the provisions of Section135 of Electricity Act 2003 and consequently direct the respondents not to disconnect the power supply to the petitioner service connection vide S.No.5626 02307 with USC 109373787.....

The complaint of petitioner is that on 04.08.2016, respondent No.3 demanded a sum of Rs.3,52,575/- from the petitioner towards additional consumption charges. On 14.09.2016, the petitioner paid a sum of Rs.1,76,288/-. The petitioner requests the respondents to refer the dispute covered by the instant demand to the Court having jurisdiction in this behalf. Without referring the dispute for decision, steps are taken by respondents to collect balance of 50% and alternatively, threatening to disconnect power supply of the petitioner. Hence, the writ petition.

The petitioner relies upon the order, dated 20.11.2014, passed by this Court in W.P.No.35231 of 2014.

Mr.Vinod Reddy, appearing for respondents, submits that the grievance of petitioner is substantially covered by the decision

referred to in W.P.No.35231 of 2014 and requests the Court to dispose of the instant writ petition in terms of the said order. Writ petition is disposed of by following the order in W.P.No.35231 of 2014.

Office to enclose copy of the order in W.P.No.35231 of 2014 along with this writ petition.
