THE HONOURABLE SRI JUSTICE M.S. RAMACHANDRA RAO Tr.CMP. No.623 of 2018 ORDER:

This petition is filed seeking to transfer the O.P. No.636 of 2017 on the file of Family Judge, City Civil Court at Secunderabad to any other Court at Warangal.

The petitioner contends that the said OP had been filed by the respondent seeking dissolution of the marriage between the parties before the Family Court, City Civil Court at Secunderabad; that petitioner is the dependant on her parents and is staying at Warangal; and it is difficult for the petitioner to travel from Warangal to Secunderabad for every date of hearing.

Counsel for the respondent states that it is difficult for the respondent also to attend the Court at Warangal and so the transfer should not be made.

The contention of the counsel for the respondent cannot be accepted because he has employment and is in a position to travel from Secunderabad to Warangal while the petitioner is unemployed and dependant on her parents and it would be difficult for her to travel to Secunderabad to attend proceedings in the OP. 5.

In view of the above, this petition is allowed and the O.P. No.636 of 2017 on the file of the Family Judge, City Civil Court at Secunderabad is transferred to the Family Court at Warangal.

MSR,J Tr.CMP.No.623 of 2018 6.

The respondent is given liberty to seek exemption from appearing on every date of hearing in the said OP., in the Family Court at Warangal in view of his employment at Secunderabad except when his presence is necessary before the Court. 7.

As a sequel, miscellaneous applications, if any pending, shall stand closed.
