Heard learned counsel for petitioner and learned Assistant Government Pleader for Revenue appearing for respondents 1 to 4.
This Writ Petition is filed for the following relief: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue order, direction more particularly one in the nature of writ of Mandamus declare the action of the respondents seeking deletion of name of the petitioner from the revenue records in respect of land covered in RS.No.400 an extent of Acs.24.29 cents situated at Reddyganapavaram Village, Buttaigudem Mandal, West Godavari District, as illegal, arbitrary and contrary to the provisions of A.P. Rights in Land and Pattadar Pass Books Act, 1974 and consequently direct the respondents not to delete name of the petitioner from the revenue records in respect of the land covered in RS.No.400 an extent of Acs.24.29 Cts situated at Reddyganapavaram Village, Buttaigudem Mandal, West Godavari District, without following the due process of law."
From a perusal of the affidavit filed in support of the Writ Petition, it is clear that as on today, there are no proceedings are issued against the petitioner with regard to deletion of his name in the revenue records in respect of the land admeasuring Acs.24.29 cents in RS.No.400 situated at Reddyganapavaram Village, Buttaigudem Mandal, West Godavari District. In view of
ARR, J W.P.No.4183 of 2017 the same, it can be said that the petitioner filed this Writ Petition only on mere apprehension and the Writ Petition is premature, as such, no relief can be granted to him.
The Writ Petition is accordingly dismissed. It is needless to observe that before the respondents take any action against the petitioner in respect of the subject land, they shall follow due process of law.
