HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.6790 of 2017 ORDER:

Heard the learned counsel for the petitioners/Accused persons of Cr.No.32 of 2017 of P.S. Dagadarthi Police Station, registered for the offences punishable u/sec.354 IPC and Section 3(l)(w)(i) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, on the report of the 2nd respondent/defacto-complainant and the learned Public Prosecutor for the 1st respondent and perused the FIR and the grounds urged in the quash petiton.

On perusal of the material, it prima facie shows the accusation against the petitioners thereby for this Court there is nothing to interdict the investigation. If any arrest of the petitioners is required, the police shall strictly follow Section 41-A of CrPC, and also the guidelines in Arnesh Kumar Vs. State of Bihar1, as the offences mentioned are not punishable above 7 years.
