HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.9627 OF 2015 O R D E R :

This petition is filed for a writ of Mandamus declaring the action of the 2nd respondent in not communicating about the proceedings in OA.No.125 of 2002, which is pending before the 2nd respondent, to the petitioner and in not giving any reply to the petitioner's representation dated 12.02.2015 and trying to evict the petitioner from the property in TS.No.944 in Block No.21, situated at Vizianagaram, as arbitrary and illegal and for a consequential direction to the respondent authorities to communicate the proceedings in OA.No.125 of 2002. The case of the petitioner is that the 3rd respondent temple has filed OA.No.125 of 2002 against his father for eviction from TS.No.944 in Block No.21, situated at Vizianagaram, belonging to the 3rd respondent temple.

While the matter stood thus petitioner's father died in the year 2007 and the petitioner was impleaded as respondent in the said OA. Thereafter, the OA was posted for orders and it is informed that orders would be communicated to the petitioner. But, till date no communication regarding the said OA was received by the petitioner. Petitioner also submitted representation dated 12.02.2015 before the 2nd respondent. But, till date nothing has been informed nor any orders pertaining to the said OA communicated to the petitioner. Aggrieved by the same, present writ petition is filed.

Heard learned counsel for the petitioner.

Ms.K.Lalitha, learned Standing Counsel for the 3rd respondent temple on instructions submits that the 3rd respondent temple is not interfering with the possession of the petitioner and that they will take appropriate action after

disposal of OA.No.125 of 2002.

Recording the above submission made by the learned Standing Counsel, writ petition is disposed of. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
