THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM COMPANY PETITION No. 155 of 2016 ORDER:

This Company Petition is filed under Section 433(e), 434(1)(a) & 439 of the Companies Act, 1956, seeking winding up of the respondent company.

At the time of hearing, it is reported by the learned counsel for the respondent, not being disputed by the learned counsel for the petitioner, that the respondent company was already directed to be wound up and the dissolution order was passed on 10.02.2017 by the National Company Law Tribunal, Hyderabad Bench at Hyderabad. It is also submitted that the Liquidator has already been appointed by the national Company Law Tribunal, Hyderabad Bench at Hyderabad by order, dated 21.09.2017, passed in C.A.No.142 of 2017 in CP(IB) No. 12/10/HDB/2017. In those circumstances, the Company Petition is closed, by giving liberty to the petitioner to approach the Interim Resolution Professional for settling their claims in accordance with law. Consequently, Miscellaneous Petitions pending, if any, shall also stand dismissed.
