This criminal petition is filed under Section 483 (1) (b) r/w.528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner seeking relaxation of condition imposed in Crl.M.P.No.565 of 2025 by the III-Additional Judicial Magistrate of First Class at Mahabubnagar. The trial Court vide order dated 25.10.2025 while granting bail, imposed certain conditions and one of the condition is that petitioner has to appear before the concerned SHO, on every Saturday between

- 2 - 10.00 A.M to 01.00 P.M., for six weeks or till filing of charge sheet whichever is earlier.

Heard Sri G.Bandaiah, learned counsel for the petitioners and Sri D.Arun Kumar, learned Additional Public Prosecutor appearing for the respondent.

The contention of learned counsel for the petitioner is that petitioner is residing at Kishanbagh, Bahadurpura, Hyderabad and working as coolie and doing other petty works and eking out his livelihood. As such, he is unable to attend before the SHO, Chinna Chintha Kunta Police Station, Mahabubnagar as directed by the trial Court. Hence, prayed to relax the said condition.

On the other hand, learned Additional Public Prosecutor opposed for relaxation of condition and prayed to dismiss this petition.

Considering the submissions made by both counsel and a perusal of material on record, the condition imposed by the trial Court by order dated 25.10.2025 in Crl.M.P.No.565 of 2025 is hereby relaxed and the petitioner is directed to appear before

- 3 - the concerned Station House Officer, as and when his presence is required. All other conditions shall remain unaltered. 6.

With the above direction, this Criminal Petition is disposed of.

Miscellaneous petitions, if any, pending shall stand closed.
