THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6628 OF 2015 ORDER:

This criminal petition under Sections 437 and 439 of the Code of Criminal Procedure is filed by the petitioner/A.4 seeking grant of bail in S.C.No.235 of 2014, on the file of the Special Judge for Economic Offences-cum-VIII Additional Metropolitan Sessions Judge at Hyderabad, arising out of crime No.256 of 2010 on the file of the P.S., Nampally, Hyderabad District, registered for the offences under Sections 147, 148, 302 read with Section 149 IPC. Heard and perused the material available on record. The allegation against the petitioner herein is that the petitioner along with the other accused chased the deceased and when the deceased rushed into the house and closed the entrance door, the petitioner and the other accused forcibly opened the door and brutally killed the deceased.

Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in the present case. The petitioner/A.4 surrendered before the Court and filed application before the Court below for recalling NBWs issued against him and that the same was dismissed. The petitioner has been in judicial custody from 30.04.2015 and as such, prays this Court to grant bail to the petitioner/A.4.

Learned Additional Public Prosecutor submits that the petitioner, after release on bail, has committed another crime and was arrested on PT warrant. He further submits that the petitioner is involved in eight criminal cases and as such, the petitioner is not entitled for release on bail. Considering the seriousness of the offence, this Court is not inclined to grant bail to the petitioner/A.4.

The criminal petition is accordingly dismissed.
