O R D E R

The case of the petitioners is that they are the land less poor persons who have constructed the houses in the land situated in R.S.No.137 of Vijayawada Village in a small extents of about 65 to 80 sq.yards, which originally belongs to the Government and the houses constructed by them are assessed to municipal tax and were assigned house numbers and they have also obtained electricity connections. While so, the 3rd respondent on 24.05.2010 along with his subordinates went to the petitioners' place and asked them to vacate their respective houses stating that land in which they have constructed the houses belongs to Government, without issuing any prior notice and without following due process of law. Aggrieved by the same, the present writ petition is filed. Counter affidavit is filed by the respondents stating that LG.O.P.

78/90 is filed before the District Judge-Cum-Special Tribunal under A.P.Land Grabbing (Prohibition) Act, Krishna and the said O.P. was allowed declaring the respondents therein as land grabbers and directed them to vacate the said land by an order dated 19.03.1996. Against the said order, the respondents therein filed land grabbing appeals and the said appeals were dismissed. It is stated that the petitioners have purchased the said houses from the respondents in LG.O.P.No.78/90. It is also stated that the petitioners have no right to occupy the Canal Bund land and are liable to be evicted.

This Court granted status-quo order on 08.06.2010. Since the respondents have asserted that they would follow due procedure envisaged under law before eviction of the petitioners, this writ petition is disposed of directing the respondents to follow due process envisaged under law before eviction of the petitioners. No costs.

As a sequel, miscellaneous petitions pending if any, shall stand closed.
