HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No. 42384 of 2015 ORDER:
Petitioner is the Field Assistant in Yendurivaripalem Gram Panchayat. The petitioner claims to have been appointed in the year 2006 and he is in continuous service.
By proceedings dated 24.06.2015, he was served with a show cause notice asking him to submit his explanation on the allegations levelled in the show cause notice. Simultaneously, his services were also placed under temporary removal.
Petitioner has filed his explanation on 10.07.2015.
The grievance of the petitioner necessitating for initiation of this writ petition is that so far, no action has been taken after submission of his explanation.
However, he was kept out of employment and there is serious endeavour made to fill up the vacancy.
2. The service conditions of Field Assistants are governed by Human Resources Policy. As per paragraph No.13 of the said Policy, whenever disciplinary action is initiated against the Field Assistant, the proceedings should be concluded within a period of 30 days. While so, in the instant case, though show cause notice was issued on 24.06.2015, so far, issue is not finalized and no reasons are forthcoming. Learned Standing Counsel for the 2nd respondent submits that the writ petition may be
disposed of granting 30 days time to finalize the proceedings.

Having regard to the above submission, the Writ Petition is disposed of directing the 2nd respondent to finalize the disciplinary proceedings against the petitioner within a period of thirty (30) days from the date of receipt of a copy of this order. Until the disciplinary proceedings are finalized, the 2nd respondent is directed not to fill up the post of Field Assistant. There shall be no order as to costs.
4. As a sequel, miscellaneous petitions, if any pending in this writ petition, shall stand closed. ___________________ P. NAVEEN RAO, J 30th December, 2015 siva
