THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.11956 of 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
"to issue writ of Mandamus to (i) declare the action of the respondents in not fixing the pay of the petitioner on par with his junior as illegal, arbitrary and unjust; (ii) and consequently direct the respondents to consider the case of the petitioner in pursuance to proceedings of the 2nd respondent in N.O.O. (CGM-HRD) Ms.No.149 dated 05.08.2015 (iii) and pass such other order."
Heard Sri B. Shiva Kumar, learned counsel for the petitioner and Sri R. Vinod Reddy, learned Standing Counsel for respondents.
When the matter is taken up, it is submitted by learned counsel for the petitioner that for redressal of the grievance of the petitioner, the petitioner herein submitted a representation on 1708-2015 to the 4th respondent herein and no orders have been passed on the said representation so far. A request is made by the learned counsel for the petitioner to direct the 4th respondent to pass appropriate orders on the representation, dated 17-08-2015, in accordance with law, by fixing some timeframe. The said request is not opposed by learned Standing Counsel for respondents and submitted that the said representation would be considered, in accordance with law.
For the aforesaid reasons, the writ petition is disposed of, without expressing any opinion on the merits and demerits of the
matter, directing the 4th respondent to consider and pass appropriate orders on the representation, dated 17-08-2015 said to have been submitted by the petitioner herein, in accordance with law, within a period of two (2) months from the date of receipt of a copy of this order.
Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
