HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.23463 OF 2017 ORDER:

This writ petition is filed by the petitioners aggrieved by the action of the respondents in insisting the petitioners to vacate their landed property of an extent of Ac.2.00 cents in survey No.594/1 situated in Rayachoty Revenue village and Mandal, YSR Kadapa District, without following the due process of law.

Heard and perused the material available on record. 3.
The main grievance of the petitioners is that they have been in peaceful possession and enjoyment of the subject land and that pattadar pass books are also in their favour and that the respondents are insisting them to vacate the above said land, for the purpose of taking over the same for widening Kadapa-Bangalore State High way, without following the due process of law.

Considering the facts and circumstances of the case and the grievance of the petitioners, without expressing any opinion on merits, this Court is inclined to pass the following order: "The respondents are directed to follow the due process of law, if they intend to acquire the land belonging to the petitioners for the purpose of widening Kadapa-Bangalore State highway." 5.
