THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE Dr. JUSTI CE SHAMEEM AKTHER WRI T PETI TI ON No.9238 of 2016 ORDER: (per SK,J) Sri N.Chandra Sekhar, learned counsel representing Sri A.Rama Krishna, learned counsel, who is stated to have been instructed to appear in this matter for the petitioner in the place of Sri J.P.Rao, learned counsel on record for the petitioner, seeks time on the ground that they received such instructions only yesterday.

There was no representation for the petitioner or its learned counsel when this matter was taken up on 04.08.2017 and it was accordingly directed to be listed 'For Dismissal' on 18.08.2017. Today, the matter appears under the said caption and the request as set out supra is made before us.

We are of the opinion that there are no bona fides in this change of counsel by the petitioner at the eleventh hour despite the matter being posted 'For Dismissal'.

Sri N.Chandra Sekhar, learned counsel, states that he is not in a position to argue the matter today.

That being so, we are left with no option but to dismiss the writ petition for non-prosecution.
