HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.27773 OF 2016 ORDER:

The petitioner was issued notice dated 04-06-2016 under Section 7 of Andhra Pradesh Land Encroachment Act, 1905 (for short " the Act"). Thereafter, the petitioner filed explanation on 20-062016. It is also the case of the petitioner that he was issued notice dated 31-03-2016 and he submitted his explanation 30-04-2016. Without passing any orders under Section 6 of the Act, the respondent-authorities are trying to dispossess the petitioner. Aggrieved by the same, the present writ petition is filed. Since it is stated that the petitioner filed explanation in pursuance to the notice dated 04-06-2016, it is for the respondent authorities to take appropriate action in accordance with law. Therefore, the 4th respondent is directed to pass final orders by considering the explanation of the petitioner. If not already passed, till passing of such orders, there shall be status-quo obtaining as on to day over the subject property.

With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
