THE HON'BLE SRI JUSTICE PRAVEEN KUMAR WRIT PETITION No.16375 of 2016 ORDER:
Heard.
The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondent-police in harassing the petitioner by calling him to the police station and making him to sit in the police station, without there being any crime registered against him and further threatening him to withdraw the complaints made by him against respondent Nos.5 and 6, as illegal and arbitrary.
Learned Government Pleader for Home placed on record the instructions received by him wherein it is stated that respondent No.4 never called the petitioner to the police station and never threatened him to withdraw his complaints alleged to have been made against respondent Nos.5 and 6. The instructions further reveal that respondent Nos.5 and 6 never threatened the petitioner to implicate him in false cases.
As seen from the record, there is no concrete material to show that the petitioner was illegally detained in the police station. But, having regard to the allegations and counter allegations made, the police authorities are directed to follow the procedure contemplated under law, before summoning the petitioner to the police station.
Accordingly, the writ petition is disposed of. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
