HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.45551 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a direction to the official respondents not to interfere with the civil disputes between the petitioner and the 4th respondent. 2.

It is stated in the affidavit that the petitioner is a consultant to the 4th respondent, who offered 2% commission on the business turnover and 10% on the derived profit in the business carried out through him. The 4th respondent had done the business with three firms through the petitioner. But he did not pay the amounts to him towards his commission. Further, the 4th respondent started defaming the petitioner in the business circle. Then, the petitioner got issued a notice to the 4th respondent to pay commission on the turnover. The said notice was returned unserved and then, the petitioner made a representation to the President, Chamber of Commerce complaining against the 4th respondent. The 4th respondent started harassing him and threatening him with dire consequences. Then, the petitioner lodged a complaint to respondents Nos.2 and 3 through his Counsel. But, at the instance of the 4th respondent, the 2nd respondent is calling the petitioner to the police station, threatening him and interfering with the civil disputes between himself and the 4th respondent. 3.

Heard and perused the material available on record. 4.

Admittedly, no case was registered against the petitioner. It is evident from the record that the petitioner lodged a complaint against the 4th respondent. Considering the facts and circumstances of the case, without expressing any opinion on merits, the official respondents are

directed not to call him to the police station and not to harass him, without there being any case against him for any cognizable offence. 5.

With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. ________________ RAJA ELANGO, J Date: 3rd January, 2017 Nn
