THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.36443 of 2012 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India for the following relief: "to issue writ, order or directions more in the nature of Writ of Mandamus to declare the inaction of the respondents particularly 3rd respondent in not investigating the complaint of the petitioner through his brother-in-law Appalanaidu, defacto complainant in Crime No.656 of 2012, dated 01-11-2012 on the file of 3rd respondent herein and not arresting the accused therein as illegal, arbitrary, unconstitutional and consequently direct the respondents particularly 3rd respondent to investigate the complaint of the petitioner through his brother-in-law Appalanaidu, defactocomplainant in Crime No.656 of 2012, dated 01-11-2012 on the file of 3rd respondent herein to arrest the accused forthwith and to investigate the matter according to law."

When the matter is called, written instructions, dated 22-06-2016 submitted by the Station House Officer, MVP Police Station, Visakhapatnam City have been placed on record by learned Government Pleader.

According to the said written instructions, the brotherin-law of the petitioner lodged a complaint with the

respondent police against one D. Annapurnamma - 4th respondent herein and basing on the same police registered a case in Crime No.656 of 2012 under Sections 448, 506 and 294 r/w.34 of IPC on 01-11-2012. It is further stated in the said instructions that after completion of investigation, charge sheet was also filed against the accused on 15-03-2013 under Sections 294 and 506 IPC on the file of IV Addl. Chief Metropolitan Magistrate, Visakhapatnam and the case is pending vide C.C.No.244 of 2013.

In view of the above developments, nothing further survives for adjudication in this writ petition. Accordingly, the writ petition is closed. There shall be no order as to costs.

The Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
