HONOURABLE SRI JUSTICE T. AMARNATH GOUD WRIT PETITION NO. 30644 OF 2013 O R D E R :
This writ petition is filed by the petitioner invoking the inherent jurisdiction of this Court under Article 226 of the Constitution of India, seeking mandamus to declare the action of the second respondent in trying to dispossess the petitioner from the land admeasuring Ac:5-00 in survey No. 672 situated at Jawhar Nagar village, Medchal Mandal, Ranga Reddy district, as illegal, arbitrary and in violation of Article 300-A of the Constitution of India and consequently to direct the respondents not to dispossess the petitioner from the aforesaid land and to pass such other suitable orders as this Court may deem fit and proper in the circumstances of the case.
2. Heard the learned counsel for the petitioner and Sri S. Buchi Reddy, learned standing counsel for the respondents.
3. The case of the petitioner is that under the threat of dispossession, the petitioner approached this Court and obtained interim orders passed by this Court in WP.No. 30644 of 2013 dated 25-10-2013. Since the petitioner is in possession and under threat this writ petition said to have been filed and the balance of convenience is in favour of the petitioner.
4. In view of the interim orders supra, this writ petition is accordingly disposed of directing the respondents not to dispossess
the petitioner from the aforesaid land without following due process of law.
5. With the above direction, the writ petition is disposed of. No costs.
6. As a sequel, miscellaneous petitions if any, pending in this writ petition shall stand closed.
