THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.31007 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the inaction of the second respondent in taking action basing on the enquiry report dated 17.04.2015 submitted by the third respondent, as illegal and arbitrary.

Heard Sri T.Sita Ramaiah, the learned counsel for the petitioners and the learned Government Pleader for Co-operation appearing for respondent Nos.1 to 3.

The petitioners are members of the Tiruvuru Circle Police Department Employees Mutually Aided Co-operative Housing Building Society Limited (for short, 'the Society'). The fourth respondent-Society was registered with the Registrar of Mutually Aided Co-operative Societies on 05.07.2005 vide Regn. No.AMC/ KNA/DCO/2005/100. It is the case of the petitioners that the third respondent conducted an enquiry and submitted his report on 17.04.2015 with regard to the affairs of the Society. The grievance of the petitioners is that the second respondent so far has not taken any action basing on the enquiry report of the third respondent.

A perusal of the record reveals that the petitioners submitted representations to the second respondent on 14.07.2015 and 16.06.2016 to take appropriate action in pursuance of the enquiry report dated 17.04.2015. For one reason or other, the second

respondent has not disposed of the said representations of the petitioners.

At the time of arguments, the only relief sought by the learned counsel for the petitioners is to direct the second respondent to dispose of the representations of the petitioners dated 14.07.2015 and 16.06.2016.

Having regard to the facts and circumstances of the case and also the submissions made by the learned counsel for both parties, the second respondent is hereby directed to dispose of the representations of the petitioners dated 14.07.2015 and 16.06.2016 in accordance with law, as expeditiously as possible, preferably within a period of six (6) weeks from the date of receipt of a copy of this order.

With the above direction, the Writ Petition is disposed of. No costs.

Consequently, Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
