THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 21327 of 2016 ORDER :
The present Writ Petition came to be filed seeking to issue a writ of mandamus declaring the action of respondent No.4 in not proceeding with the investigation in crime No.199 of 2016 though it was registered on 21.05.2016, as illegal and arbitrary.
2. Heard the learned counsel for the petitioner and the Assistant Government Pleader for Home for the State of Andhra Pradesh appearing for respondents 1 to 4. At the request of both the counsel, the Writ Petition itself is taken up for disposal at the stage of admission. Since this Court is not adjudicating the case on merits, it may not be necessary to hear unofficial respondents 5 to 9.
3. The petitioner challenges the inaction on the part of respondent No.4 in conducting investigation in crime No.199 of 2016. As seen from the record, the crime is registered for the offences punishable under Sections 384, 352, 447, 506, 509, 511, 307, 354, 120B read with 34 of the Indian Penal Code, 1860. The learned Assistant Government Pleader states that the police are investigating into the matter and having regard to the
nature of the offences alleged, it may take some time to file final report.
4. Having regard to the circumstances of the case, respondent No.4 is directed to complete investigation in the aforesaid crime and file a final report, in accordance with law, at the earliest.
5. The Writ Petition is disposed of with the aforesaid direction. Miscellaneous petitions pending, if any, in the Writ Petition shall stand closed in the light of this final order. No order as to costs.
