THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.31827 OF 2017 ORDER:

The Tahsildar, Charla Mandal, Bhadradri Kothagudem District, passed orders on 12.06.2017 under Section 6 of the Andhra Pradesh Land Encroachment Act, 1905 (for short, 'the Act'). Aggrieved thereby, petitioner preferred appeal before the Revenue Divisional Officer, Bhadrachalam, under Section 10 of the Act. Along with the said appeal, petitioner also filed application for grant of stay of the order passed by the original authority. Alleging inaction on the stay application filed by the petitioner and in the meantime, the respondent authorities are threatening to dispossess him, this Writ Petition is filed.

Having regard to the facts of the case, the Writ Petition is disposed of directing the Revenue Divisional Officer, Bhadrachalam, to consider the prayer sought by the petitioner in the application praying to grant stay of the order of the Tahsildar dated 12.06.2017 as expeditiously as possible preferably within a period of two weeks from the date of receipt of a copy of this order. Pending consideration of such appeal, the respondent authorities are directed not to dispossess the petitioner from the subject property till stay application is considered. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in the Writ Petition shall stand closed.
