THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.7384 of 2012 ORDER:

Heard learned counsel for petitioner, the Assistant Government Pleader for Revenue for 1st respondent and Sri Vinod for 4th respondent.

The prayer of petitioner is substantially against inaction of respondents 2 and 4 in removing constructions illegally undertaken by 3rd respondent as illegal, arbitrary and unconstitutional.

In spite of service of notice, the respondents have not chosen to file counter.

Keeping in view the limited grievance of petitioner, particularly against inaction to take against the construction undertaken by 3rd respondent, I am satisfied the writ petition can be disposed of by this order.

The petitioner is given liberty to re-submit representation dated 07-01-2012 by enclosing a copy of this order to 4th respondent within four weeks from the date of receipt of a copy of this order. The 4th respondent causes personal inspection of the premises of 3rd respondent. If the 3rd respondent has undertaken construction or continuing to undertake construction contrary to the Municiplaities Act, the 4th respondent ac ts in the matter in accordance with law, after issuing notice to 3rd

respondent as well. The said exercise shall be conducted and completed within three months from the date of receipt of a copy of this order.

The writ petition is disposed of accordingly. No order as to costs.
