Petitioner claims that his father, who was working as Male Nurse in the 3rd respondent institute, died on 07.03.2010. His mother predeceased his father and his father married another lady. Petitioner sought appointment on compassionate grounds. His step-mother also consented. There were some internal disputes regarding claiming of benefits. Step-mother of the petitioner sought appointment on compassionate grounds to her. The competent authority rejected the claim of the step-mother. She filed O.A.No.9914 of 2012 before the Andhra Pradesh Administrative Tribunal. The said O.A. was dismissed by the Tribunal affirming the decision of the competent authority. Though an assurance was given to provide employment and hurdle created by his step-mother was removed, step-mother also consented for providing employment to the petitioner, but there was no further progress. Therefore, petitioner made a representation dated 20.04.2017 ventilating his grievance, but the same is not acted upon so far.

Learned counsel for the petitioner fairly submits that since representation dated 20.04.2017 filed by the petitioner is pending, if a direction is issued to the respondents to consider the said representation and to pass appropriate orders thereon, it would suffice the interest of the petitioner.

Having regard to the said submission, without expressing any opinion on merits of the case, Writ Petition is disposed of
directing the Superintendent of Institute of Mental Health, Hyderabad, the 3rd respondent, to consider the claim of the petitioner as ventilated in his representation dated 20.04.2017 and pass appropriate orders as warranted by law by assigning due reasons in support of the decision, as expeditiously as possible, preferably within a period of six weeks from the date of receipt of a copy of this order and communicate the decision to the petitioner. There shall be no order as to costs.
Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
