This writ petition filed under Article 226 of the Constitution of India, questions the order dated 12.8.2015 passed by the 3rd respondent under Section 44(2-A) of Andhra Pradesh Forest Act, 1967, ordering confiscation of Toyota Innova TN09-AV-3381 along with (06) Red Sander logs weighing 229 kgs. to the State of Andhra Pradesh.

Today, when the matter is taken up, a preliminary objection is taken by the learned Government Pleader appearing for Respondents that the order under challenge is appealable before the District Court and without availing the said alternative remedy, this writ petition is filed directly before this Court under Article 226 of the Constitution of India. 3.
In view of availability of alternative remedy to the District Court as submitted by the learned Government Pleader, this Court is not inclined to entertain the present writ petition and is accordingly dismissed, with a liberty to the petitioner herein to file appeal before the appellate forum questioning the impugned order and it is open for the appellate forum to pass appropriate orders, in accordance with law.
