HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 19030 of 2016 ORDER:
Heard learned counsel for the petitioner and Government Pleader for Home. With the consent of both the parties, the present writ petition being taken up for disposal at the admission stage itself.
The present Writ Petition came to filed seeking issuance of a Writ of Mandamus declaring the of the third respondent in not completing the investigation in Crime No.166 of 2015 of Mulugu Police Station, registered for the offences punishable under Sections 290, 323, 419, 420, 452, 468, 471 and 506 read with 34 IPC, as illegal and arbitrary; and consequently to direct the third respondent to investigation and file charge sheet against the accused in the above crime as early as possible. Learned counsel for the petitioner submits that though the above crime was registered in the month of July, 2015 for the offences punishable under Sections 290, 323, 419, 420, 452, 468, 471 and 506 read with 34 IPC, no action has been initiated till date.
Learned Government Pleader for Home submits that investigation in the above crime is in progress and the police will take appropriate steps in filing the final report, at the earliest. In view of the representation made and having regard to the nature of allegations made, the respondent-police shall proceed with the investigation in Crime No.166 of 2015 of Mulugu Police
Station, Warangal District, in accordance with law and file a final report as expeditiously as possible, preferably, within a period of twelve (12) weeks from the date of receipt of a copy of the order. With the above direction, the writ petition is disposed of. No order as to costs.
Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
