THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.31378 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the inaction of the respondent Nos.2 to 4 in taking action on the petitioner's representation dated 08.8.2016 as illegal and arbitrary. 2.

Heard learned counsel for the petitioner, learned Assistant Government Pleader for Fisheries (Andhra Pradesh) and learned Government Pleader for Revenue (Andhra Pradesh). 3.

The petitioner claims to be the owner of an extent of Acs.2.44 cents in R.S. No.336-2 in Chinapalaparru Village, Mudinepalli Mandal, Krishna District. On the south of the petitioner's land, the fifth respondent and his family members are having an extent of Acs.5.45 cents in R.S. No.335 of Chinapalaparru Village. The Fisheries Department has granted permission on 29.7.2016 to the fifth respondent and others for conversion of agricultural land into fish tank. The case of the petitioner is that the fifth respondent obtained permission by making misrepresentation to the Fisheries Department as if the petitioner is not having land on the north of proposed fish tank. The grievance of the petitioner is that if the fifth respondent is permitted to dig the fish tank, his land becomes barren. On coming to know about the suppression of material facts by fifth respondent, the petitioner has made representation dated 08.8.2016 to the second respondent to enquire into the matter and do the justice. The second respondent received the same under the acknowledgement dated 10.8.2016.

At the time of the arguments, the only relief sought by the learned counsel for the petitioner is that the second respondent may be directed to dispose of the petitioner's representation dated 08.8.2016 as early as possible. The learned Assistant Government Pleader also consented for disposal of the representation. 5.

Having regard to the facts and circumstances of the case and also the submissions made by learned counsel for both the parties, the second respondent is hereby directed to dispose of the representation of the petitioner dated 08.8.2016, as expeditiously as possible, preferably within a period of six (6) weeks from the date of receipt of a copy of this order.

With the above direction, the writ petition is disposed of. Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
