THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.24511 OF 2017 ORDER:
The writ petition is filed questioning the action of the respondents in not taking any steps against the unlawful activities being conducted before the petitioner's premises i.e., M/s. Padma Sri Wines, Door No.343-59/1, 1A & 4, Gnanapuram Main Road, Ward No.44, Visakhapatnam, pursuant to the complaint in FIR No.271 of 2017 dated 24.06.2017 and representation dated 18.07.2017, as arbitrary and illegal. When the matter is taken up for hearing, the learned Government Pleader for Home had placed on record the written instructions dated 28.07.2017, received from the Sub Inspector of Police, Kancharapalem, Visakhapatnam city, which reads as under:
"It is submitted that the 6th respondent police have also been taking timely action to prevent any unlawful activities before the petitioner's shop by constant patrolling in the area. Further, the petitioner has not approached the 6th respondent police station with any complaint subsequent to registration of Crime No.271 of 2017 dated 24.6.2017." In the light of the above written instructions submitted by the learned Government Pleader for Home stating that the respondent police have already initiated the action, the writ petition is disposed of with a direction to the respondent police to take necessary action as and when required.
