HONB'E SRI JUSTICE CHALLA KODANDARAM WRIT PETITION No.2172 OF 2017 ORDER:

The writ petition is filed questioning the action of the respondents in not granting dispatch permits for transportation of Road Metal & Building Stone over an extent of 8.500 Hectors in Sy.No.116, Mallapuram Village, Rayadurg Mandal, Anantapuram District, pending revision petition dated 10.09.2016 filed by the petitioner under the A.P. Minor Mineral Concession Rules, 1966, aggrieved by the Demand Notice dated 16.06.2016, issued by the 4th respondent. Heard the learned counsel for the petitioner and the learned Government Pleader for Mines and Geology (A.P). Learned counsel for both parties while relying on the order dated 08.11.2016, passed by this Court in W.P.No.38280 of 2016, submits that the revision petition dated 10.09.2016 filed by the petitioner is pending with the respondents.

In the circumstances, as the revision petition filed by the petitioner is pending with the respondents, without expressing any opinion, the writ petition is disposed of directing the 1st respondent-revisional authority to dispose of the revision petition dated 10.09.2016 filed by the petitioner within a period of eight weeks from the date of receipt of copy of this order. In the interregnum period, the petitioner shall deposit 1/3rd of the impugned demand notice within a period of two weeks from today and on submission of the proof of payment, the petitioner shall be issued dispatch permits forthwith. However, it is needless to mention that the amount directed to be deposited shall be subject to the result of the revision petition dated 10.09.2016, filed by the petitioner.

With the above direction, the writ petition is disposed of. No order as to costs.

Miscellaneous petitions, if any pending in this writ petition shall stand closed.
